Terms of Service

Full terms of service are in preparation. data-fit LLC is engaging qualified SaaS legal counsel to prepare a complete Master Subscription Agreement (MSA), Order Form, and Data Processing Agreement (DPA). These documents will govern all commercial relationships and will be provided to prospective customers during the evaluation and contracting process.

What governs your use of DecisionFlow

Access to and use of DecisionFlow is governed by a signed Master Subscription Agreement between your organization and data-fit LLC. Until such an agreement is executed, access is limited to evaluation and demonstration environments and is subject to the conditions set out in any evaluation agreement or letter of engagement.

Permitted use

DecisionFlow is a sales compensation management platform for use by authorized personnel within your organization. It is not permitted to:

Reverse engineer, decompile, or attempt to extract source code from the platform
Use the platform to process data for any organization other than your own without express written authorization
Resell or sublicense access to the platform without a signed reseller agreement
Use the platform in any manner that violates applicable law

Intellectual property

DecisionFlow™ and the data-fit™ name and marks are trademarks of data-fit LLC. The platform, its source code, design, and all proprietary methodology are the intellectual property of data-fit LLC and are protected under applicable copyright and trade secret law.

Your organization retains ownership of all data you input into the platform. data-fit LLC does not claim any ownership over your compensation data, employee data, or business data.

Limitation of liability

During the pre-commercial evaluation period, DecisionFlow is provided for demonstration and evaluation purposes. data-fit LLC makes no warranties, express or implied, regarding the platform's fitness for any particular purpose. Full warranty terms will be established in the signed Master Subscription Agreement.

Governing law

data-fit LLC is registered in Texas, United States. Commercial agreements are governed by the laws of the State of Texas unless otherwise agreed in writing.

Changes to these terms

These interim terms will be replaced by a full Master Subscription Agreement prior to any commercial contract. data-fit LLC reserves the right to update this page. Material changes will be communicated to evaluation and production customers directly.
